Los fotovoltaicos consiguen que la Eurocámara pida una investigación por el recorte de primas al sector
Esta decisión fue adoptada en respuesta a un requerimiento de la Asociación Nacional de Productores de Energías Renovables (Anper), que se había dirigido a la Eurocámara para denunciar una infracción del Tratado de la Unión Europea y de la Carta de Derechos del Ciudadano de la UE, y para pedir su intervención.
En su petición, tramitada a través de la oficina del Parlamento Europeo en Madrid, Anper aseguró que el real decreto ley 14/2010, con el que el Gobierno quiere ahorrar 2.200 millones de euros en primas fotovoltaicas en tres años, «ataca los derechos de los ciudadanos de España».
En el escrito de respuesta, la Comisión de Peticiones anunció su decisión de admitir a trámite la demanda porque considera que afecta al ámbito de la Unión Europea y adelantó que solicitará al Ejecutivo comunitario «una investigación preliminar sobre los diferentes aspectos del problema».
El nuevo frente comunitario se suma al abierto también a nivel internacional por quince fondos foráneos, que están promoviendo en Londres con ayuda del despacho Allen & Overy un arbitraje contra el Gobierno español por el recorte de primas del real decreto ley 14/2010.
Mientras, las comunidades autónomas de Valencia y Murcia han planteado sendos recursos ante el Tribunal Constitucional contra los recortes aplicados por la misma norma, al considerarlos retroactivos.
Además, las principales asociaciones fotovoltaicas están reclamando ante el Supremo la anulación del decreto 1565/2010 de noviembre del año pasado, en el que se recortaba a 25 años el periodo con derecho a percepción de primas.
En este frente, la Asociación de la Industria Fotovoltaica (ASIF) presentó al Supremo un informe de Eclareon en el que se cifra en más de 2.000 millones de euros el impacto asociado a este recorte, al que el sector considera retroactivo.
