Unesa asegura que Industria avaló con sus recomendaciones algunos hechos cuestionados por la CNC
Competencia acordó imponer una multa de 61,2 millones de euros a las cinco principales eléctricas (Endesa, Iberdrola, Gas Natural Fenosa, HC y E.ON) y a la patronal por dos infracciones «muy graves»: haber obstaculizado el cambio de suministrador en el mercado eléctrico entre mayo de 2007 y junio de 2009, justo antes de la liberalización, y haber pactado precios para los grandes consumidores en el marco de la desaparición de las tarifas eléctricas.
En la primera de ellas, según fuentes de Unesa, Competencia se basó en una serie de indicios extraídos de la conducta de Unesa y de las empresas, que, o bien «han sido avalados por el Ministerio de Industria, Turismo y Comercio o la Comisión Nacional de Energía (CNE)», o que la propia CNC consideró que no constituyen infracción administrativa, o bien los tribunales de justicia apreciaron inicialmente la razonabilidad jurídica de las mismas o ya fue sancionado.
Estos indicios, explicaron desde Unesa, fueron, por un lado, que las distribuidoras suspendieran durante cinco días el acceso de las comercializadoras a sus bases de datos de puntos de suministro en junio de 2009, justo antes de la entrada en vigor de la tarifa de último recurso (TUR), la única regulada y a la que están acogidos unos 23 millones de clientes.
Unesa señaló que Industria, en un informe requerido por Competencia, afirmó que se trató de algo «puntual» motivado por la situación critica en los programas y procesos de las empresas, en mitad de un traspaso «masivo» de clientes, que no frenó el proceso de liberalización «ni dañó a las comercializadoras independientes». La patronal señaló además que hasta el 23 de junio no conocieron cómo iba a ser el paso de los clientes a esta nueva tarifa regulada.
Por todo ello, subrayaron, carece de toda «lógica jurídica» pensar que estos comportamientos fueron un indicio para la construcción de una infracción «muy grave», como señala la CNC, cuando la actuación de las eléctricas y Unesa fue «la más adecuada posible según el Ministerio».
Otro indicio de Competencia para señalar esta infracción es que las eléctricas denegaran datos para dificultar a las comercializadoras independientes el acceso a los datos sobre clientes que la Ley prevé y las exigieran algunos datos de los clientes antes de cederles las bases de datos, una práctica que, según Unesa, no quedó prohibida de forma expresa hasta mayo de 2008. A partir de ahí, añaden, se cedieron todos los datos de carácter personal.
En este sentido, recordó que su actuación estuvo justificada, puesto que el consentimiento del interesado respecto de la cesión de datos de carácter personal (como los solicitados por las comercializadoras acerca de los clientes: cuenta bancaria, DNI, perfil de consumo, etcétera) es una exigencia impuesta por la Ley Orgánica de Protección de Datos.
Con respecto a la otra conducta que sanciona Competencia, la que se refiere a la contratación con los grandes clientes entre 2006 y 2008, Unesa sostuvo que mantuvo reuniones de carácter general con Industria en las que en ningún momento se fijaron condiciones concretas de los contratos entre las empresas y los grandes consumidores.
El objetivo de estos encuentros separados con las principales empresas suministradoras de electricidad y los principales consumidores (englobados en AEGE) era detectar, evaluar e implementar las acciones oportunas que permitiesen eliminar las tarifas de alta tensión «sin dejar a ningún consumidor sin suministro o con uno más caro».
Asimismo, la patronal apuntó de nuevo que las reuniones se llevaron a cabo por iniciativa de Industria para intentar buscar líneas de entendimiento con AEGEy que finalizaron sin consenso alguno y sin llegar a fijar ningún contrato tipo.
De hecho, las eléctricas se defendieron asegurando que fue el ministerio de Industria el que dio las pautas «que debían regir en los contratos y el que convocó las renuniones».
Por su parte, Industria señaló que cumplió con su deber al animar a que se mantuvieran contactos regulares entre las principales empresas suministradoras de electricidad y los principales consumidores así como al elaborar la normativa del sector.
Unesa, que al igual que el resto de compañías implicadas anunció su intención de llevar a los tribunales el expediente de la CNC, tiene hasta el 13 de julio para recurrir la multa de 900.000 euros impuesta ante la Audiencia Nacional.
La asociación, que se mostró plenamente convencida de la admisión del recurso, no descartó pedir medidas cautelares y confió en que la justicia les de la razón y anule finalmente la multa de Competencia, puesto que entiende que su actitud estuvo justificada, no supuso una barrera de entrada para las compañías independientes y no produjo ningún efecto anticompetitivo.
De hecho, Iberdrola y Endesa, advirtieron que si, pese a su defensa en la Audiencia Nacional (y, en su caso, al Tribunal Supremo) «se las considera culpables, se reservan el correspondiente ejercicio de responsabilidad patrimonial ante el Estado».
Es muy repetitivo este diario con el tema de REE, del que además no dejan opinar y hay que hacerlo en otras noticias.
Otra vez hoy «REE, más que un operador de transporte y de sistema eléctrico», uno ha de pensar que esto no es un diario sino un lobby de las electricas, y que miente conscientemente (otra cosa sería presumir incompetencia) cuando dice y reitera semana tras semana que la separación que se le va a imponer a REE es consecuencia del tercer paquete; muy al contrario REE cumple perfectamente con el modelo preferido por la Comisión Europea, ha sido un modelo inspirador del tercer paquete, y separar transportista y operador solo se contempla como opción B cuando la actividad se desarrolla dentro de un grupo integrado y el mismo desea mantener la propiedad. Por mucho repetir una mentira no se convierte en verdad.
Seamos claros: se quiere debilitar a REE porque estorba a las eléctricas en su actividad de generación, las mismas cuyas maniobras de colusión han sido probadas en varias ocasiones y por las que han sido multadas -recientemente por importe de 61 millones de euros, esto es dato duro-, pese a estar defendidas por sesudos gabinetes de abogados y economistas (algunos ahora en Industria, sin periodo de transición previsto), y la ambición de REE de entrar en el bombeo es algo que no le van a perdonar y la quieren resquebrajar.
Y cuando escriban la verdad podrán discutir si desde un punto de vista teórico tiene sentido o no la separación porque haya o no otros incentivos perversos que hay que solventar con la normativa. Ahora mismo el debate en estas páginas, que no se produce porque carece de credibilidad, estaría contaminado por la visceralidad del informador. Energiadiario, cn sus ataques constantes a la CNE bordeando el ridículo, por inadecuadas que sea su presidenta o las disposiciones que deberían garantizar el rigor e independencia de la institución, no es creible en el sector y es una pena, porque es el único enfocado en el sector de la energía.
La independencia del transportista y del regulador son un pilar de un sistema energético que funcione bien. El de la prensa es un pilar de la democracia, este medio debe explicar sus vínculos con las eléctricas, y muy en particular con una de ellas.
Esto lo dice un lector asiduo que confía en que este diario avance por el camino de la rigurosidad para fomentar el debate energético en la sociedad.
Aprovecho el comentario de Julio para incidir en el tema, aunque sea extemporáneo en esta noticia.
Creo que, en los artículos de opinión, Energía Diario tiende a una reiteración que resulta pesada.
En muchas ocasiones coincido con el núcleo de la opinión (las sorprendentes opiniones de varios consejeros de la CNE a tenor de sus votos particulares, el escándalo del proceso de su selección o el obvio conflicto de interés entre ser transportista único y operador del sistema lo que tiene mucho que ver con que la revalorización de la cotización de REE supere con mucho la del Ibex, etc.), pero también echo en falta alguna alusión a que continuamente se «torturen» las estadísticas por parte de los agentes implicados (patronales, sindicatos, ecologistas, renovables vs petroleros, …) para solicitar apoyos injustificables.
Comprendo que está en su papel la presión que cada lobby realiza, pero creo que Energía Diario es muy condescendiente con la mezcla de medias verdades y burdas simplificaciones con la que todos los días nos obsequian los agentes energéticos y, sin embargo, concentra toda su ironía sobre muy pocos destinatarios, casi siempre los mismos. Me pregunto si existe alguna razón que lo explique.
