El informe, correspondiente a 2010, cifró en cerca de 120.000 los casos de inadecuada acreditación de cambio de suministrador de luz o la documentación acreditativa fue insuficiente, sobre un total de dos millones de cambios de suministro de aquel año. En el caso del gas, el porcentaje ronda el 3%, o unos 30.000 casos dentro del millón de cambios registrados.
Esta situación, consideró la CNE, requiere un refuerzo de las actuaciones tanto del regulador como de la Ocsum con el objetivo de incentivar las buenas prácticas comerciales y agilizar los procedimientos correctivos de los cambios que se hayan realizado sin la conformidad de los consumidores.
Junto a esto, el organismo presidido por Alberto Lafuente estimó conveniente que la oficina de cambio de suministrador debería mostrar «mayor proactividad» en la puesta en marcha de un sistema de verificación que respete los requisitos legales de conformidad expresa de los clientes y que, al mismo tiempo, incentive a los comercializadores a poner en práctica modelos de captación de usuarios que cumplan los requisitos.
Por otro lado, el consejo de la CNE aprobó la convocatoria de una audiencia a través del Consejo Consultivo de Hidrocarburos por un periodo de 10 días para conocer la opinión de los agentes acerca del borrador que establece el mecanismo para la asignación coordinada de capacidad de interconexión de gas natural entre España y Portugal.

El regulador también respondió a una consulta sobre las facturas impagadas del suministro de gas tras la venta de una vivienda. Según indicó, los contratos de suministro, como cualquier otro tipo de contratos, sólo producen efectos ‘inter partes’, y siguen produciendo derechos y obligaciones mientras no se den de baja de la forma contemplada.
De esta forma, las deudas con origen en facturas impagadas de suministros de gas anteriores a la venta de una vivienda no están ligadas a la vivienda, pues derivan de un contrato de suministro que es personal entre la persona física y la empresa suministradora.
No obstante, si el nuevo propietario de la vivienda no diese de alta un nuevo contrato de suministro, en tiempo y forma razonable, y pasa a disfrutar de los servicios del anterior suministro, «podría interpretarse que se produce una contratación tácita, en cuyo caso el nuevo propietario tendría que formalizar un contrato y abonar las facturas del suministro de gas generadas desde la transferencia de propiedad de la vivienda».
