La CNE no sale del armario

En términos de comunicación, vivimos tiempos de ‘outing’, de lo que se denomina salir del armario, de que la transparencia traslade al escenario público, de una forma cada vez más abierta, los comportamientos personales y empresariales. Parece que de esta nueva realidad no se ha hecho eco la Comisión Nacional de Energía, resolviendo de una forma muy triste su oposición a la reforma de la Ley del Sector Eléctrico, en la que casi no ha tomado ni arte, ni parte.

Hace quince días, todos los miembros del Consejo de Administración de la Comisión Nacional de Energía suscribían un acuerdo contra la reforma de la Ley del Sector Eléctrico que estaba tramitando el Parlamento. El acuerdo se recogió casi como un acertijo en la nota de prensa posterior al Consejo, no haciendo mención en ningún caso a la Ley que en esos momentos volvía al Congreso procedente del Senado.

En su acuerdo los consejeros urgían a los representantes políticos tres inquietudes de particular relevancia, tras el texto acordado por el PP y el PSOE en el Senado. En primer lugar, la CNE se mostraban en contra de la supresión de la mención expresa a los “criterios de seguridad, regularidad y calidad de los suministros”, en virtud de los cuales podría justificarse la falta de capacidad como motivo suficiente para denegar el acceso a las redes, afectando a este derecho en el sistema eléctrico como garantía del uso no exclusivo de las mismas.

En segundo lugar, también se mostraba en contra de la modificación legal del régimen de acceso al tránsito de energía por redes ajenas, de forma que la Comisión entendía que el Proyecto mermaba este derecho reconocido con carácter general a los sujetos del sistema eléctrico.

Finalmente, también se mostraba contraria a que la ley atribuyese ser monopolio único a RED ELÉCTRICA DE ESPAÑA S.A (hoy empresa privada) como operador del sistema, gestor único de las redes de transporte y transportista principal, para atribuirle el derecho para ostentar la titularidad de todas las redes de transporte.

Ni en el apartado de Comunicados de Prensa, ni en el de Ultimos Informes y Publicaciones, se incorporó este posicionamiento de los Consejeros (referencia 44/2007), siendo las dos secciones en las que se puede seguir la actualidad (los informes son consecutivos) de las publicaciones y decisiones del regulador. Más tarde, concretamente el día 12 de junio, se publicaba esta declaración, que reproducimos en esta noticia, en la web del organismo. Su ubicación, el Catálogo de Publicaciones de la CNE, en la búsqueda por criterios cronológicos.

Teniendo en cuenta que la ley se iba a aprobar el día 14 de junio, es lógico pensar que una declaración realizada o conocida dos días antes y por la puerta de atrás, evidencia una actitud farisea: poco efecto público y político se puede conseguir con unos procedimientos tan silentes. De hecho, no hay medio de comunicación que se haya hecho eco de una cuestión de evidente relevancia informativa, como un posicionamiento contrario de un órgano regulador y un llamamiento a los grupos políticos.

Por tanto, poco puede hacer una posición timorata de estas características a la hora de ganar la respetabilidad que un órgano regulador se merece. Parece como si la CNE guardase muchas precauciones a la hora de mostrarse contraria a los designios políticos. La alternativa a que haya sido de forma deliberada por guardar estas precauciones sería otra muchísimo más grave para la institución y se califica por sí sola. Peor que la censura es la autocensura.

¿Se lo habrán enviado por este conducto a los representantes políticos, tal y como era su intención? Es necesario que los consejeros de la CNE hagan ‘outing’.
