La CNE aplaza el análisis de miles de recursos fotovoltaicos hasta contar con liquidaciones en firme
Fuentes del regulador explicaron que la jurisprudencia actual, basada en la posición del Tribunal Supremo, establece que el análisis por la CNE de los recursos debe realizarse sobre la liquidación en firme y no sobre un acto que se encuentra sometido a trámite. «No son recurribles hasta que no son actos definitivos», aclararon.
El recorte de primas que está siendo impugnado por los fotovoltaicos ante la CNE corresponde a la limitación de horas con derecho a retribución fotovoltaica contemplada en el real decreto ley 14/2010 aprobado por el Gobierno a finales del año pasado para acabar con el déficit de tarifa del sector eléctrico.
Dentro de los diversos frentes judiciales abiertos por esta norma, los promotores fotovoltaicos están recurriendo en paralelo ante la Audiencia Nacional y ante la CNE las liquidaciones mensuales de primas realizadas por el regulador a partir de la nueva norma.
La Abogacía del Estado, en representación de la CNE, sostiene que los recursos actualmente presentados deberían ser inadmitidos, ya que solo podrían presentarse contra la liquidación definitiva, que se realizará a finales de 2012.
Por su parte, el despacho Brenes Abogados, que asesora a los productores fotovoltaicos, consideró que la CNE «obstaculiza» la resolución de los recursos «con el único objetivo de retrasar el procedimiento».
«A la CNE no le interesa que se resuelvan los miles de recursos presentados contra el recorte de primas fotovoltaicas» y «frente a los mismos solo utiliza estrategias procesales para ganar tiempo y no la resolución del asunto«, afirmaron.
Para Brenes Abogados, el «único objetivo» de la CNE es «retrasar cuando sea posible que la Justicia resuelva sobre el fondo de la cuestión controvertida» y, en particular, sobre la «dudosa constitucionalidad» del real decreto ley 14/2010.
