Industria desestimó por un motivo formal una planta termosolar de Iberdrola Renovables en Almansa
De esta forma lo expresó en la Comisión de Industria del Senado en respuesta a una pregunta formulada por el senador del PP Fermín Cerdán sobre los motivos del Ministerio de Industria, Turismo y Comercio para negarse a autorizar esta instalación.
Hernández manifestó que el motivo de la denegación es «puramente formal», ya que la Dirección General de Energía y Minas y la Abogacía del Estado consideraron que no se cumplió uno de los requisitos.
Explicó que la legislación establece que este tipo de instalaciones deben inscribirse en un registro de preasignación y, para ello, deben cumplir con una serie de requisitos, entre los que figura el de disponer de la licencia de obras expedida por la administración local competente.
En su solicitud, prescisó, Iberdrola Renovables Castilla-La Mancha no acreditó el cumplimiento del apartado de la licencia de obras expedida por la administración local competente, motivo por el cual se desestimó su solicitud por resolución de la Dirección General de Política Energética y Minas del 7 de mayo de 2010.
Ante la presentación de la licencia de obras parcial, la Dirección General de Política Energética y Minas consultó a la Abogacía General del Estado, que determinó que era incontrovertible que la licencia de obras era parcial y que no cabía entender cumplido el requisito de disponer de licencia de obras.
El senador del PP consideró llamativa la decisión del Departamento de Industria, que atribuyó a los «vaivenes» de la normativa en esta materia, pero mostró su tranquilidad por la intención de Iberdrola Renovables de retomar la inversión en 2013.
Cerdán destacó que la ciudad de Almansa que cuenta con 25.000 habitantes y 50.000 hectáreas de superficie, es un lugar propicio para la inversión en energías renovables, como eólicas y fotovoltaicas.
Indicó que en los últimos años se instalaron en la zona distintas e importantes empresas del sector mientras el marco legislativo les hacía atractiva la inversión, pero esta dinámica se frenó ante la «inseguridad jurídica» generada por las decisiones del Ministerio.
La inversión de la planta termosolar de Almansa supera los 250 millones de euros, según Cerdán, quien destacó que esta instalación supondría la creación de más ochocientos puestos de trabajo durante los tres años de construcción de la planta, cien empleos estables durante sus cuarenta años de vida útil y cientos de puestos de trabajos indirectos en industrias auxiliares.
