Iberdrola y Unesa logran detener la multa histórica impuesta por la CNC
En el caso de Iberdrola, esta suspensión cautelar evita el pago de 21,6 millones de euros, mientras que en el de Unesa la cuantía asciende a 900.000 euros. En total, el organismo presidido por Luis Berenguer había sancionado a las cinco grandes eléctricas y a la patronal con 61,2 millones de euros, de los que 26,6 millones corresponden a Endesa, 8,8 millones a Gas Natural Fenosa, 1,8 millones a HC y 1,42 millones a E.ON España.
La CNC impuso en mayo esta sanción al considerar que las eléctricas habían obstaculizado el cambio de comercializador en el mercado libre y tratado de fijar precios a los grandes clientes tras la desaparación de las tarifas reguladas. Estas prácticas habían sido concertadas en el seno de Unesa, según Competencia.
Esta multa fue la segunda mayor de la historia de la CNC, solo por detrás de la sanción en noviembre de 2009 a seis aseguradoras por hacer un cártel para fijar precios mínimos en el seguro decenal de daños a la edificación de viviendas.
Tras recibir en mayo la sanción, todas las eléctricas y Unesa anunciaron que la recurrirían ante los tribunales, al considerar entre otras cuestiones que había sido el propio Ministerio de Industria, para garantizar el suministro a los grandes consumidores, quien habían alentado las reuniones.
Otro de los argumentos empleados por las eléctricas ante la Justicia había sido el de que la suspensión de la entrega a comercializadoras de datos de clientes durante cinco días a mediados de 2009, poco antes de la entrada en vigor de la liberalización, respondió a los retrasos de Industria al publicar las modificaciones normativas para proceder con garantías al traspaso de millones de clientes a las nuevas comercializadoras.
En su resolución sancionadora, la CNC consideró que «las cinco principales empresas eléctricas del país son responsables de sendas infracciones a la normativa de defensa de la competencia» por haber «obstaculizado» el cambio de comercializador y «haber tratado de fijar precios a los grandes clientes en el mercado de la desaparición de las tarifas eléctricas».
Esta resolución es el resultado de una denuncia presentada en junio de 2009 por la Asociación de Comercializadores Independientes de Energía (ACIE) acerca de la suspensión por parte de Endesa e Iberdrola de la gestión telemática de solicitudes de baja tensión y el corte de operaciones.
