El Gobierno adapta las leyes del sector eléctrico y de hidrocarburos a las directivas comunitarias

En cuanto a la modificación de la Ley de Hidrocarburos, el anteproyecto, de 1998, tiene por objeto fundamental trasladar al ordenamiento jurídico español las especificaciones contempladas en la Directiva del Mercado Interior de Gas, de 2009.

Los principales puntos que transpondrá el anteproyecto de ley son la separación funcional del transporte de hidrocarburos de las actividades de producción y suministro.

Asimismo, en el contenido del anteproyecto se dota a la Comisión Nacional de Energía de funciones y competencias adicionales de acuerdo con lo establecido en la citada directiva comunitaria.

Finalmente, se actualizan otros aspectos no derivados de la directiva comunitaria, relacionados con la adquisición, mantenimiento y gestión de las reservas estratégicas de gas natural, o el establecimiento de las bases para el desarrollo de un mercado organizado de gas, que busca dotar de una mayor liquidez y transparencia al mercado, así como una asignación más eficiente de los recursos y la entrada de nuevos agentes en el mercado.

Por su parte, el anteproyecto de ley que modifica la Ley del Sector Eléctrico, de 1997, incorpora al ordenamiento jurídico español las previsiones contenidas en la directiva sobre normas comunes para el Mercado Interior de la Electricidad, de 2009.

Dichas previsiones están centradas, fundamentalmente, en el refuerzo de las competencias y funciones de la autoridad reguladora, la Comisión Nacional de Energía, así como de su independencia.

De igual forma, se incluyen medidas relacionadas con la protección al consumidor, tales como el establecimiento de puntos de contacto únicos de información a los consumidores o la incorporación del concepto de «consumidor vulnerable».
