El Gobierno crea el concepto de consumidor vulnerable de gas y plantea un bono social del butano
El anteproyecto también habilita al Gobierno para poner en funcionamiento un bono social para determinados consumidores de bombonas de butano con capacidades de entre 8 y 20 kilogramos.
Otras de las novedades del anteproyecto son la separación patrimonial para los gestores de la red de transporte y la ampliación de las competencias de la Comisión Nacional de la Energía (CNE).
Sobre derechos de los consumidores, se incluye un catálogo completo de los derechos de los consumidores en relación con el suministro de gas natural, así como un plazo máximo de tres semanas para el cambio de suministrador.
Además, se habilita al Ministerio de Industria, Turismo y Comercio a establecer condiciones específicas de suministro para aquellos consumidores que, por sus características económicas, sociales o de suministro, tengan la consideración de clientes vulnerables.
Entre los objetivos del anteproyecto destacan el de asignar la gestión de la red troncal de gasoductos, infraestructuras de transporte primario necesarias para la seguridad y funcionamiento eficaz del sistema a los gestores de red de transporte.
El anteproyecto establece además las bases para el desarrollo de un mercado organizado de gas en España, extiende la aplicación de las disposiciones de la ley al biogás, al gas obtenido de la biomasa así como a otros tipos de gas, siempre que sea técnicamente posible su inyección en la red de gas natural, y habilita a CORES para adquirir, mantener y gestionar las reservas estratégicas de gas natural que se deberán mantener prioritariamente en los almacenamientos básicos del sistema.
Sobre el refuerzo de la independencia y funciones de la CNE, se asignan al regulador nuevos cometidos, como los de establecer las metodologías para el cálculo de los peajes de acceso a las instalaciones, para la prestación de servicios de balance y para el acceso a las infraestructuras transfronteriza.
Además, se otorga potestad sancionadora a la CNE en los casos de incumplimiento por parte de los sujetos obligados en las cuestiones relacionadas con obligaciones derivadas de la separación de actividades, acceso de terceros a las instalaciones y la toma de participaciones en sociedades sin la previa autorización o cumplimiento de las condiciones establecidas.
