El CCU advierte de la inexistencia de garantías para los usuarios en el anteproyecto del sector eléctrico
El Consejo explicó que en sus alegaciones al anteproyecto de ley, que sirve para trasponer la directiva comunitaria sobre la materia, se mostró «muy crítico» con los nuevos cambios legales.
El texto elaborado por el Ministerio de Industria, Turismo y Comercio es «ambiguo, equívoco y basado en simples consideraciones y propuestas de buena voluntad, e ignorante de las medidas recogidas en la directiva para reforzar y garantizar los derechos de los consumidores y aumentar su información».
Así, consideró que, mientras que la protección de los consumidores constituye el «eje central de las reformas contempladas en la directiva», el anteproyecto «no hace referencia a la garantía del cumplimiento del servicio público que el Estado debe garantizar, y tampoco hace alusión al listado de propuestas que a nivel europeo se consideran esenciales para equilibrar las distintas fuerzas» en el mercado.
El CCU aseguró que el Gobierno ha descuidado algunos aspectos que a nivel europeo se consideran «esenciales», como que el cliente que desee cambiar de proveedor en las mismas condiciones contractuales lo pueda efectuar en tres semanas y sin cargo alguno, o la plasmación del derecho del cliente a recibir todos los datos pertinentes sobre su consumo.
Otra medida defendida por la Unión Europea es que en las facturas o junto a ellas, los suministradores indiquen la contribución de cada fuente energética, las fuentes de información existentes y cómo acceder a ellas, la información relativa a las vías de solución de conflictos o la creación de puntos de contacto para los consumidores, entre otros aspectos.
La Unión Europea también aboga por la existencia de un defensor del pueblo para la energía o un órgano de los consumidores para tramitar eficazmente las reclamaciones y la solución extrajudicial de los conflictos.
El CCU criticó también que el anteproyecto no contemple un procedimiento claro para la resolución de conflictos, de modo que los mismos dependen de «buena voluntad» de las empresas.
El texto, señaló, debería recoger explícitamente la obligación de promover la transparencia de los costes y precios de la electricidad. Un método de cálculo del precio de la electricidad basado en los costes marginales, como ocurre en la actualidad, es a su juicio «perjudicial para los consumidores, ineficiente económicamente, y totalmente especulativo para las empresas».
El Consejo también consideró que la norma debería definir claramente un concepto de «consumidor vulnerable» que abarque a la población que realmente necesita de medidas de apoyo y regular las medidas de protección de los consumidores, en especial la de los de menos recursos económicos.
